Rent is Due
Missed or partially paid.
Day 1: No legal action can be taken yet. The tenant has until midnight on the due date to pay the rent.

Serve the N4 Notice
Serve N4 Form
Day 7: We file the notice to end tenancy early for non-payment of Rent. This is the first mandatory legal step. We serve this notice as early as the 7th day after the rent was due. Our N4 clearly state the full amount of rent owed.

Payment Arrangement
Setup an Arrangement
Day 14: We attempt to setup a payment arrangement with the tenant for the missed rent. Pay half of the missed rent before the termination date with balance + rent for the following month.

N4 Termination Date
The N4 termination date is reached
Day 21:(Day 7 + 14 days minimum for a monthly tenancy). This is the tenant’s last day to "void" (cancel) our N4 notice by paying all rent arrears owed up to this date. If they pay the full amount, our eviction process stops. If they do not pay and do not move out, the notice expires, and we proceed to file an L1 form.

File L1 Application
To Evict Tenant for Non-payment of Rent and to Collect Rent Owed.
Day 22: This is the earliest day we submit an application to the LTB. We must always file this application the day after the N4 termination date. Filing early will result in our application being dismissed, forcing us to start over.
Documents Required
✔ Form L1 (Completed and signed)
✔ A copy of the Form N4 that we served
✔ A completed Certificate of Service (proving how and when we served the N4)
✔ The required LTB filing fee

LTB Hearing Schedule
receive Notice of Hearing from the LTB.
Day 60 to Day 120+: The LTB will schedule a hearing, often weeks or months after filing, depending on their current backlog. Our strong legal representative attend to present our case to the LTB. This is where a decision is made and an official Eviction Order (Order of the Board) may be issued.

Eviction Enforcement
Eviction is enforced via the Court Enforcement Office (Sheriff)
Should the LTB issues an Order for Eviction and the tenant still has not moved out by the date specified in the order, we file the order with the Sheriff's office to have it legally enforced. Owners cannot enforce an eviction themselves.
