Terms of Service

1. Acceptance

By accessing or using Zulma (the “Platform”), you (“Customer” or “you”) agree to these Terms of Service (the “Terms”), entered into with Zulma Resources Inc. (“Zulma”, “we”, “us”), an Ontario corporation. If you do not agree, do not use the Platform.

2. Service description

Zulma operates a technology platform that connects Customers seeking residential cleaning and lawn care services with independent contractor service providers (“Crew” or “Cleaners”) serving the Niagara region of Ontario, Canada. Zulma owns the Platform, the booking infrastructure, the brand, and the Customer relationship; Crew perform the services in their independent capacity.

The Platform may add or remove service categories from time to time. Service availability varies by municipality and season; lawn care availability in particular is seasonal (typically April through November in the Niagara region), and snow services run in the winter months (typically November through March).

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into binding contracts in the Province of Ontario to use the Platform. You must provide truthful, accurate, and complete information when registering an account.

4. Account registration

You are responsible for the security of your account credentials and for all activity under your account. Notify us immediately at hello@zulma.ca if you suspect unauthorized access.

5. Booking and payment

  • Prices displayed on the Platform are in Canadian dollars (CAD). HST is itemized on every quote before you confirm.
  • Same-day, weekend peak, and other dynamic adjustments are presented as transparent dollar amounts on every quote. No hidden fees.
  • Two payment models are supported and clearly labelled at checkout:
    • Card pre-authorization (default when card payments are enabled): your card is pre-authorized for the quoted amount when you confirm the booking. No charge is captured until a Crew member accepts the job. If no Crew member accepts in time, the hold is released.
    • Pay on completion (current beta default): no card on file is required; you settle with the Crew member after the visit (cash, e-transfer, or invoice).
  • Recurring bookings (weekly, biweekly, monthly) lock the agreed per-visit price for the duration of the schedule, subject to material changes (e.g., a service-area-wide rate adjustment) communicated at least 30 days in advance.
  • Receipts are issued in compliance with the Canada Revenue Agency (CRA) requirements for HST documentation.

6. Tips

Tips are entirely optional. When you add a tip through the Platform, 100% of the tip amount goes to the Crew member who performed the work. Zulma takes no portion of any tip. Tips are settled separately from the base service price and are not refundable once paid.

7. Cancellation and refunds

The cancellation fee depends on the timing of your cancellation:

  • Before any Crew member accepts: no charge; authorization fully released.
  • 2+ hours before scheduled time: no charge; full release.
  • 1-2 hours before: $30 late-cancel fee paid to the Crew member who blocked their time.
  • Less than 1 hour before: 50% of the booking total.
  • After Crew arrival or job start: full charge applies.

Crew members may cancel a job with notice; if a Crew member cancels more than 30 minutes before scheduled arrival, your authorization is released in full and we'll work to rebook you.

8. Memberships

What a membership includes. Zulma+ is a paid membership for homeowners. What it includes is listed on the Zulma+ page when you join. Those are the benefits your membership carries.

Price. Zulma+ costs $9.99 a month or $99 a year, plus HST. You see the full price, with HST, before you join, and on your membership page afterwards.

Zulma Portfolio. Zulma Portfolio is Zulma+ for owners of 4 or more homes, with a seat for each home. Its price for your homes is shown, with HST, before you join or upgrade, and on your membership page after. Homes 1 to 3 are always free.

Seats. A seat covers one home for your plan's month or year. Covering a home with no free seat adds one, charged at once for the rest of the term, after you see the amount and agree. A removed home's seat stays yours to the term's end, and a home you add in the meantime uses it free. At renewal your seats come to the fewest of the seats you paid for, the number you chose, and the homes you have. Nothing is refunded for a seat you no longer use, apart from the 14-day rule under Cancelling. With more homes than seats, your seats cover the homes you added first.

Homes that count. A home counts if you own it, co-own it, or hold its place for an owner who isn't on Zulma. A home you only watch doesn't count.

On the House. A home with a job paid through Zulma in a billing month isn't charged for its seat that month, and your free homes go to the homes without one. A job paid through Zulma is a Zulma visit completed at that home, or a visit completed there on a job you booked with a business on Zulma, when you paid its invoice through Zulma. A job paid outside Zulma doesn't count. The credit comes off your next bill (on a yearly plan, your renewal), before HST. It is never paid in cash, and a credit not yet taken off a bill ends when your plan ends.

Fewer than 4 homes. With fewer than 4 homes at renewal, your plan goes back to Zulma+ then. We email you first.

Zulma+ and your homes. Zulma+ covers the first three homes you added: folders, searching inside PDFs, video and asking more businesses work on those homes. Its money benefits apply to your whole account.

Extra storage. You can add storage in 10 GB steps on your membership page. A raise is charged at once for the rest of your plan's month or year, and a lower amount starts at renewal. A charge for extra storage or a seat alone doesn't start the 14 days under Cancelling, and it is refunded with your plan's payment when that payment is refunded.

Renewal. Your membership renews at the end of each month or year until you cancel. On each renewal date we charge the card saved for your membership. If your membership starts with a free trial, you are not charged until the trial ends. We email you before your first charge, and you can cancel before then at no cost. You can have one free trial, apart from the 30-day Zulma Portfolio trial.

The 30-day Zulma Portfolio trial. A Zulma+ member may be offered it once. During it every home is covered. At its end your seats join your plan, charged for what is left of your plan's month or year, as you agreed, unless you stop it first on your membership page. We email you before it ends. Nothing is charged if what you agreed no longer holds, for example if your plan is paused or ending, or you have fewer than 4 homes.

If a payment doesn't go through. Your member benefits stop until it does. You can update your card on your membership page, and we try the payment again.

Pausing. You can pause a monthly membership for 1, 2 or 3 months, once in any 12 months. You are not charged while it is paused, and member benefits are off until it resumes.

Cancelling. You can cancel at any time on your membership page on zulma.ca.

  • If you cancel within 14 days of a payment that started your membership or renewed it for a year, and you have not used a money benefit since that payment, your membership ends at once and that payment goes back to your card in full. The money benefits are cashback, a late-cancel fee waived and a same-day rush fee covered.
  • Otherwise nothing is refunded, and your membership stays active until the end of the period you paid for.
  • Refunds go back to your card, not to your Zulma credits.

Deleting your account. Deleting your account stops your membership from renewing. If you do not restore your account within 30 days, your membership ends then, with no refund.

Changes to a plan or its price. We will tell you by email at least 30 days before a change takes effect. If you don't want the change, you can cancel your membership before then.

9. Weather and force majeure

Lawn care visits in particular are weather-dependent. Zulma or the assigned Crew member may reschedule a visit at no charge to you when weather makes the work unsafe or ineffective (active rain, lightning, snow on bare ground, wet grass that would clump, ice, etc.). We'll notify you the night before or as soon as conditions develop, and reschedule to the next available dry day in your window.

Snow services are similarly weather-dependent: during an active storm, whiteout, or freezing-rain event, the assigned Crew member may pause or reschedule the visit at no charge to you. Snow clearing and de-icing reduce, but do not eliminate, winter hazards. Crew members clear snow and apply de-icer where purchased; neither Zulma nor the Crew member guarantees ice-free or bare surfaces, and conditions can change quickly after a visit. You remain responsible for monitoring and treating your property's surfaces between visits.

Beyond weather, neither party is liable for delays or non-performance caused by events outside reasonable control: power outages, government orders, network outages, civil disruption, or natural disaster. We'll make a good-faith effort to reschedule and refund pre-authorizations promptly.

10. Customer + crew obligations

As a Customer, you agree to:

  • Secure cash, jewellery, prescription medications, firearms, and irreplaceable items before the Crew member arrives. Items left in the open are presumed not valuable for claim purposes.
  • Provide a safe and accessible work environment.
  • Disclose pets, hazards, and special instructions.
  • For lawn care: ensure gates are unlocked or share access details, and keep pets indoors during the visit.
  • Treat the Crew member with respect and dignity.

Crew members agree to:

  • Arrive on time, in clean attire, with appropriate supplies and equipment.
  • Complete the agreed scope of work to professional standards.
  • Capture before/after photos where reasonable and where the Customer has not opted out (see Photos section below).
  • Treat your home, yard, and possessions with care.
  • For lawn care: comply with all applicable municipal bylaws on noise, equipment hours, and waste disposal.

11. Lawn services: noise + bylaws

Most Niagara-region municipalities restrict use of gas-powered or amplified equipment outside of standard daytime hours (typically 7:00 a.m. to 9:00 p.m. on weekdays, and slightly later starts on weekends). Zulma Crew members will not arrive before the earliest local allowed start time without explicit Customer permission and confirmation that the property is detached enough that neighbours won't be disturbed.

If your municipality enforces stricter rules (e.g., Sunday bans on power equipment), let us know in your booking notes and we'll route accordingly. Customers are responsible for checking their own municipality's noise bylaw if scheduling outside of standard hours.

12. Photos

Crew members may take before/after photos of the work areas to document quality, protect against false damage claims, and improve service. Photos are stored privately, accessible only to you, the Crew member, and Zulma support, and are deleted within 30 days unless attached to an active dispute.

You may opt out of photo capture at any time by leaving a note on the booking. Crew members will respect your wishes; if a dispute later arises and there are no photos, we'll resolve it on the available evidence.

13. Insurance

Zulma maintains:

  • Commercial General Liability insurance with $5,000,000 in coverage (underwritten by Tokio Marine Canada Ltd. via Zensurance Brokers Inc.) for third-party property damage and bodily injury arising from Crew negligence while performing services booked through the Platform.

Zulma requires independent contractor Crew members to carry their own $2,000,000 Commercial General Liability policy. In a market's launch phase, Crew members may begin accepting jobs before their own policy is on file and are given a grace period to provide proof; not every Crew member may carry their own insurance during this period. You can see an individual Crew member's background-check and insurance verification status on their profile before a visit. Zulma's own $5,000,000 policy described above applies to eligible Platform-booked services regardless. Crew members are responsible for their own equipment, vehicle, and any insurance they choose to carry beyond these minimums. WSIB coverage for domestic-residential cleaning and lawn services is not mandatory in Ontario; Crew members may register for WSIB voluntarily.

Services arranged outside the Zulma Platform are not covered. Zulma's insurance responds only to services booked, paid, and delivered through the Platform. Any cleaning, lawn, or detailing work arranged directly with a Crew member off-platform — including but not limited to follow-up jobs, side arrangements, or referrals outside the booking flow — is not insured by Zulma, and Zulma has no liability for damage, theft, injury, or quality complaints arising from such arrangements.

Coverage is subject to the terms and conditions of the applicable policies. Damage claims must be reported within 48 hours of service through your booking detail page. Suspected theft must be reported within 24 hours and to local police. Help Center has the full claim process.

14. Limitation of liability

To the maximum extent permitted by Ontario law, Zulma's aggregate liability arising from any single booking is limited to the greater of (a) the price paid for that booking and (b) the proceeds available under our insurance. Zulma is not liable for indirect, incidental, special, consequential, or punitive damages.

Pre-existing damage is not covered; we encourage a brief pre-clean walkthrough between you and the Cleaner.

Assumption of risk. Zulma is a technology platform that connects you with independent contractors; it does not itself perform the services and does not supervise the day-to-day work. You acknowledge that home and on-site services carry inherent risks, and — to the maximum extent permitted by law — you accept those risks. This does not limit any rights you cannot waive under the Consumer Protection Act, 2002 (Ontario).

15. Disputes

Most disputes are resolved through our internal process. File a report from your booking history within the applicable window:

  • Property damage: within 48 hours
  • Missing items: within 24 hours
  • Quality issues: within 7 days; free re-clean when reported within 24 hours
  • Cleaner conduct: within 72 hours
  • Billing discrepancies: within 7 days

Disputes that cannot be resolved internally within 7 days may be referred to mediation and then, to the extent permitted by applicable law, to binding arbitration seated in Ontario, on an individual (non-class) basis. Nothing in this section limits any right you have under the Consumer Protection Act, 2002 (Ontario), including any right to bring or participate in a proceeding that the Act protects; Ontario law prevails over this clause where they conflict. Either party may otherwise seek relief in the courts of Ontario.

16. Independent contractor relationship

Crew members using the Platform are independent contractors, not employees of Zulma. Crew members set their own hours, may accept or decline work without penalty, may work for competing services, and may send qualified substitutes (subject to capability + background-check verification). Zulma provides the platform, brand, dispatch, and customer relationship; Crew members provide the work.

Tax treatment: Crew members are responsible for their own income tax, CPP contributions, and (where applicable) HST registration and remittance. Zulma issues a T4A annually for any Crew member earning $500 or more in a calendar year, summarizing total payouts.

Crew indemnity. Each Crew member separately agrees, in their contractor agreement with Zulma, that they are solely responsible for their own work and conduct and will indemnify Zulma for claims arising from the services they perform. This is an agreement between Zulma and the Crew member and does not limit any right you have directly against Zulma or the Crew member.

17. Intellectual property

All Platform content, branding, software, and trademarks are owned by Zulma Resources Inc. or its licensors. You receive a limited, non-exclusive license to use the Platform for its intended purpose. Reverse engineering, scraping, or redistribution is prohibited.

18. Modifications to these terms

We may revise these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance.

19. Termination

You may close your account at any time from Account. We may suspend or terminate access for material breach, fraud, or risk to other users, with notice where reasonable and consistent with applicable law.

20. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The courts of Ontario have exclusive jurisdiction over any disputes arising from these Terms or your use of the Platform.

22. Data credits

Current weather conditions shown in the app contain information licensed under the Environment and Climate Change Canada Data Servers End-use Licence.

Weather is reported by the nearest station and is not a forecast, an alert, or advice. Zulma neither produces it nor guarantees it, and nothing in the app should be relied on for decisions about severe weather.

23. Homesake

Homesake keeps the documents for your home in one place, such as an invoice from a business you paid through Zulma. To fill in their details for you, Zulma reads the documents you keep in Homesake with AI, whether or not you have turned on “Let Zulma read your documents with AI”. Only the document is sent, and only to read it; our AI provider does not use it to train its models and deletes it within 30 days. What it finds is a suggestion you can change. By using Homesake, you agree to it being read this way. If you do not want a document read, do not keep it in Homesake.
